Governor is willing to reimburse Mr Saint his expenses, it being fully understood that such payment shall
not be considered
future cases, and
it
was
clearly the
understanding of the Chief Justice and
of the Defendants' Counsel that costs
in this particular
case were
to
be borne
by the losing party, Counsel for both
parties are willing not to press for decision in the matter, but that the
expenses shall be paid and received upon the basis of the understanding alone I mentioned, viz.
that the questions referred to remain open for
argument.
